In compliance with the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter the “LFPDPPP”), COFOR, SA DE CV, (hereinafter “COFOR”), with registered address at Cerrada Matamoros 47, Colonia Tlalnepantla Centro, CP 54000, Tlalnepantla de Baz, State of Mexico; informs you that it is responsible for the use and protection of your personal data; which are treated in a strictly private and confidential manner. Therefore, the obtaining, processing and exercise of the rights derived from said personal data are done through appropriate, legitimate and lawful use, always under the principles of legality, consent, quality, information, proportionality, responsibility, loyalty and purpose and the duties of security and confidentiality established in the LFPDPPP, its Regulations and secondary provisions.

The personal data we may collect from you as a customer or prospective customer through our website are as follows:

We inform you that COFOR may contact you through various means, such as telephone and/or email, as well as through any other means you request. We also inform you that COFOR does not request personal data from third parties related to you in your capacity as a customer.

Purposes of the treatment

Your personal data will be processed exclusively for the following purposes, which are necessary to participate in the recruitment process as a client:

1. Identify you as a COFOR client or prospective client.

2. Create, manage, control, and administer your client record.

3. Register you in our systems and/or databases.

4. Issuing invoices.

Additionally, COFOR may process your personal data for the following different or secondary purposes, which are not necessary for your participation as a client or prospective client, but which allow us to provide you with better service and maintain closer contact with you:

1. To inform you about the services and/or products that COFOR can offer you as a customer or prospective customer.

2. To send you notifications regarding new services and/or products, as well as communications related to them.

We inform you that if you do not express your refusal to process your personal data for these secondary purposes, we will understand that you have given us your consent to do so.

If you object to the processing of your personal data for the purposes other than or secondary to those previously mentioned, this will not be grounds for us to deny you participation as a client or prospective client at COFOR.

It is important that you trust that the personal data you provide to us will be treated confidentially, exclusively for the purposes described and only to the extent necessary to fulfill the purpose for which it was collected.

Security measures

At COFOR, we have implemented security measures with physical, electronic, and administrative procedures, using advanced technologies that limit the use or disclosure of your data. This allows us to maintain proper control over your personal data and prohibits unauthorized removal of any information containing personal data in any format from COFOR offices.

We also require our service providers, with whom COFOR maintains a legal relationship, to comply with these security measures.

Data transfer

At COFOR, we will not share your personal data with third parties, except when necessary in the cases provided for in the LFPDPPP and its Regulations.

Therefore, in accordance with the provisions of Article 37 of the LFPDPPP, COFOR may transfer your personal data without your consent, in the cases indicated below:

i. When the transfer is provided for in a law or treaty to which Mexico is a party.

ii. When the transfer is necessary for medical prevention or diagnosis, the provision of healthcare, medical treatment, or the management of healthcare services.

iii. When the transfer is made to controlling companies, subsidiaries, or affiliates under the common control of the controller, or to a parent company or any company in the same COFOR group that operates under the same internal processes and policies.

iv. When the transfer is necessary by virtue of a contract entered into or to be entered into in the interest of the data subject by COFOR and a third party.

v. When the transfer is necessary or legally required to safeguard a public interest, or for the prosecution or administration of justice.

vi. When the transfer is necessary for the recognition, exercise, or defense of a right in a judicial proceeding.

Mechanisms to revoke consent

Revocation of consent implies the right of all data subjects to withdraw their consent for the continued processing of their personal data. Therefore, at any time, you have the right to revoke the consent you have given us for the processing of your data, so that we can stop using it. However, there will be times when we cannot comply with your request within the requested timeframe and/or conclude processing immediately, as we may need to continue processing your personal data due to a legal obligation.

The procedure for revoking consent, if applicable, will be the same as that established in the immediately following section for exercising ARCO rights.

What mechanisms and procedures do we have in place at COFOR for exercising your ARCO rights?

ARCO Rights consist of the rights you have to access, rectify, cancel, or oppose the processing of your personal data.

Therefore, as the owner of your personal data, you have the right to know what personal data COFOR maintains, what we use it for, and the conditions of its use (Access). You also have the right to rectify it if it is inaccurate, outdated, or incomplete (Rectification). You may instruct us to cancel it when it is excessive or unnecessary for the purposes described that justified its collection. You may consider that it is not being used in accordance with the principles, duties, and obligations set forth in the applicable regulations (Cancellation). You may also object to the use of your personal data for specific purposes (Opposition), in cases where the LFPDPPP so permits. To exercise your ARCO rights, you may send an email to the following address: direccion@cofor.com.mx. The email you send must be accompanied by documents that prove your identity (official identification) or, where applicable, that of your legal representative. If you do not have an email address, you can send your request by postal mail to the following address: Cerrada Matamoros 47, Colonia Tlalnepantla Centro, CP 54000, Tlalnepantla de Baz, State of Mexico.

If the information provided in the email is insufficient or incorrect, or if the referenced documents are missing, COFOR may request you, on a one-time basis, to provide the necessary elements or documents to process your request within five days of receiving it. You will have ten days from the date of receipt to respond to the request. If you do not respond within this period, your request will be deemed not submitted.

If the application is duly completed and accompanied by the required documentation, COFOR will communicate its decision within a maximum period of twenty days, counting from the date on which the application is complete and duly submitted.

If the request is admissible, COFOR will make its determination effective within a period of fifteen days from the notification of the corresponding determination, granting access, rectifying or cancelling your data, or your right to object will be made effective (or your consent will be revoked). If applicable, personal data will be provided free of charge, through the issuance of electronic documents to the email address you have provided for such purposes. If you do not receive a response from COFOR or if the response provided is not satisfactory, you have the right to go to the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI) to submit a data protection request within fifteen days following the date on which the deadline for COFOR to respond to your request expires in accordance with the LFPDPPP and its Regulations, as well as the procedure we have established for this purpose, or the response we have given to it.
